TERMS OF USE
These Terms of Use (“Terms”) govern your access to and use of the Home Advocates Union (“HAU,” “we,” “us,” or “our”) website, member areas, communications, events, programs, resources, platforms, and services.
By accessing or using HAU’s website, applying for membership, maintaining membership, attending an event, submitting information, making a payment, or otherwise engaging with HAU, you agree to these Terms.
1. HAU’s Mission and Scope
HAU is a homeowner-advocacy organization. HAU may provide advocacy, education, research, public-policy communications, community resources, membership services, event programming, and general information concerning homeowner issues.
HAU reserves the right to change, suspend, discontinue, modify, or remove any program, resource, benefit, membership level, website feature, event, platform, or communication at any time.
2. HAU Is Not a Law Firm
HAU IS NOT A LAW FIRM. HAU DOES NOT PROVIDE LEGAL ADVICE, LEGAL SERVICES, OR LEGAL REPRESENTATION.
No information provided by HAU—including website content, educational materials, advocacy resources, communications, discussions, document lists, research tools, referrals, workshops, or public information—constitutes legal advice.
Your use of HAU’s website, membership, materials, communications, or services does not create an attorney-client relationship with HAU or any HAU officer, director, employee, volunteer, contractor, speaker, contributor, or representative.
You are responsible for consulting an independently licensed attorney regarding your personal legal rights, court deadlines, foreclosure matters, bankruptcy matters, title issues, consumer claims, tax matters, or other legal concerns.
3. HAU Is Separate From Home Information Support (H.I.S.)
HAU is separate from Home Information Support (“H.I.S.”).
HAU does not own, control, supervise, guarantee, warrant, insure, or assume responsibility for any product, service, report, subscription, educational offering, communication, transaction, outcome, or representation provided by H.I.S.
Your purchase, use, or reliance upon an H.I.S. product or service is governed by the applicable H.I.S. terms, disclosures, policies, and agreements. HAU membership does not create any right to receive an H.I.S. product, service, report, discount, subscription, or result unless HAU expressly states otherwise in writing.
4. Membership
Membership in HAU is a conditional, revocable privilege—not a property right, employment relationship, legal-representation agreement, or guarantee of continued access.
HAU may, in its sole and reasonable discretion and to the fullest extent permitted by law:
- Refuse a membership application;
- Suspend, restrict, revoke, terminate, or decline to renew a membership;
- Remove a person from an HAU event, forum, platform, committee, chapter, program, or communication channel;
- Restrict access to HAU resources, materials, benefits, or services; and
- Take other action necessary to protect HAU’s mission, members, staff, volunteers, partners, legal compliance, safety, or operations.
Membership decisions by HAU are final.
5. Zero-Tolerance Conduct Policy
HAU has zero tolerance for conduct that HAU determines is detrimental to its mission, safety, integrity, members, operations, reputation, legal compliance, or community.
Prohibited conduct includes harassment, threats, intimidation, stalking, retaliation, discrimination, hate speech, violence, fraud, deception, impersonation, misuse of HAU resources, unauthorized solicitation, misuse of member information, false claims of authority, and any conduct that HAU determines undermines its mission or harms others.
HAU may remove content, restrict access, suspend membership, revoke membership, decline renewal, report suspected unlawful conduct, or take other protective action without prior notice when HAU determines immediate action is appropriate.
6. Payments, Membership Dues, and Donations
Membership dues, fees, registrations, and other payments may be required for access to certain HAU membership levels, programs, events, or resources.
Except where required by law or expressly approved in writing by HAU, payments are nonrefundable.
Donations, contributions, and payments to HAU are not tax-deductible as charitable contributions. HAU does not provide tax advice. You should consult your own qualified tax professional regarding the tax treatment of any payment made to HAU.
7. No Guarantee of Results
HAU does not guarantee any legal, financial, housing, advocacy, legislative, personal, professional, or other result.
HAU does not promise that you will avoid foreclosure, secure a loan modification, obtain a settlement, prevail in court, receive government action, retain a home, resolve a title issue, obtain a referral, or achieve any particular outcome.
You are solely responsible for your own decisions, filings, deadlines, legal obligations, financial obligations, and use of information obtained through HAU.
8. Permitted Use of HAU Materials
HAU grants you a limited, personal, revocable, nonexclusive, nontransferable right to access HAU website content and authorized membership materials for lawful personal use consistent with these Terms.
You may not, without HAU’s prior written permission:
- Copy, reproduce, distribute, publish, sell, license, modify, or commercially exploit HAU content;
- Use HAU materials to provide legal advice, legal services, or legal representation;
- Remove copyright, trademark, ownership, or attribution notices;
- Use HAU content to create a competing service or database;
- Share member-only materials, passwords, access credentials, or subscriptions with unauthorized persons;
- Scrape, harvest, crawl, download, or extract data from HAU systems;
- Misrepresent yourself as HAU, an HAU representative, or an authorized spokesperson; or
- Use HAU’s name, logos, trademarks, or materials without authorization.
9. User Submissions and Public Forums
You are responsible for the content you submit, upload, post, send, or share through HAU platforms, forms, events, forums, or communications.
You represent that you have the right to provide the content and that it does not violate another person’s rights, confidentiality, privacy, intellectual-property rights, or applicable law.
HAU may, but is not required to, review, remove, restrict, preserve, disclose, or report user content when HAU believes it is necessary to enforce these Terms, protect HAU or others, respond to legal process, or address prohibited conduct.
10. Third-Party Content and Links
HAU may reference or link to third-party websites, organizations, professionals, resources, products, services, or content. Such references do not constitute an endorsement, legal referral, guarantee, certification, recommendation, partnership, or assumption of responsibility by HAU.
You are responsible for evaluating third-party information and services before relying upon or purchasing them.
11. Disclaimer of Warranties
HAU provides its website, materials, membership resources, communications, and services on an “as is” and “as available” basis.
To the fullest extent permitted by law, HAU disclaims all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, noninfringement, availability, security, and uninterrupted access.
HAU does not warrant that its website or materials will be error-free, current, complete, secure, uninterrupted, or suitable for your individual circumstances.
12. Limitation of Liability
To the fullest extent permitted by law, HAU and its officers, directors, employees, volunteers, contractors, representatives, and affiliates shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of HAU’s website, membership, communications, services, materials, events, or resources.
To the fullest extent permitted by law, HAU’s total liability for any claim arising from these Terms shall not exceed the amount you paid directly to HAU during the twelve months preceding the event giving rise to the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless HAU and its officers, directors, employees, volunteers, contractors, and representatives from claims, liabilities, losses, damages, costs, and expenses arising from your violation of these Terms, your misuse of HAU resources, your submitted content, or your unlawful conduct.
14. Governing Law
These Terms shall be governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.
Any dispute arising from or relating to these Terms shall be brought in a state or federal court with proper jurisdiction in New Jersey, unless applicable law requires otherwise.
15. Changes to These Terms
HAU may update these Terms at any time. Updated Terms will be posted on the HAU website with a revised effective date. Continued use of HAU’s website, membership, programs, or resources after the updated Terms take effect constitutes acceptance of the revised Terms.
